Distance Sales Contract

This Distance Sales Contract (“Agreement”) is concluded electronically between the following parties in accordance with the applicable provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.

Article 2 – Subject of the Contract

The subject of this Agreement is to determine the rights and obligations of the parties regarding the reservation and sale of tourism services, yacht charter services, private tours, and related travel services purchased electronically by the Buyer through the Seller’s website.

Article 3 – Service Information

Details of the purchased service including service type, service date, number of participants, total price, and payment information are provided in the Reservation Summary, which forms an integral part of this Agreement.

Article 4 – Payment

The Buyer agrees to pay the full service amount using the payment methods provided on the website. The reservation becomes valid only after the payment is successfully completed and confirmed by the Seller.

Article 5 – Service Delivery

The Seller undertakes to provide the purchased service on the agreed date, time, and location specified in the reservation confirmation. If the Buyer fails to attend the service at the agreed time and location, the service shall be considered fulfilled.

Article 6 – Right of Withdrawal

In accordance with Article 15 of the Regulation on Distance Contracts, the Buyer acknowledges that the right of withdrawal cannot be exercised for services related to accommodation, transportation, car rental, food and beverage supply, and leisure activities that are to be performed on a specific date or period.

Article 7 – Cancellation and Refund

Cancellation and refund procedures are governed by the Cancellation & Refund Policy published on the Seller’s website, which forms an integral part of this Agreement.

Article 8 – Personal Data Protection

The personal data of the Buyer is processed in accordance with the Privacy Policy published on the Seller’s website. By accepting this Agreement, the Buyer acknowledges and consents to the processing of personal data as described in the Privacy Policy.

Article 9 – Force Majeure

In cases of events beyond the control of the parties, including natural disasters, government restrictions, severe weather conditions, or other force majeure situations, the parties may mutually agree on rescheduling or refund terms in accordance with operational feasibility.

Article 10 – Applicable Law and Jurisdiction

Turkish Law shall apply to disputes arising from this Agreement. Consumer Arbitration Committees and Consumer Courts authorized under applicable legislation shall have jurisdiction.

Article 11 – Effectiveness

The Buyer is deemed to have accepted all terms of this Agreement once the payment for the reservation is completed electronically.
